Approval of resolution concerning free air time of candidates for president of Brazil

The Superior Electoral Court (TSE) approved, in an administrative session on August 5 (Tuesday), a resolution concerning the use of the free air time for political advertising on radio and TV for candidates for president of Brazil in the 2014 elections and the media plan. The free political advertising on radio and TV begins on August 19 and ends on October 2, in the first round. In other words, advertising will begin 47 days prior to the first round and will end three days before the elections.

According to the resolution, the 25 minutes of political advertising in blocks of candidates for president, at the free air time on radio and TV, will be divided as follows: Coligação Com a Força do Povo – 11min24s; Coligação Muda Brasil – 4min35s; Coligação Unidos pelo Brasil – 2min3s; Partido Social Cristão (PSC) – 1min10s; Partido Verde (PV) – 1min4s; Partido Socialismo e Liberdade (PSol) – 51s; Partido Social Democrata Cristão (PSDC) – 45s; Partido Renovador Trabalhista Brasileiro (PRTB) – 47s; Partido Socialista dos Trabalhadores Unificado (PSTU) – 45s; Partido Comunista Brasileiro (PCB) – 45s; and Partido da Causa Operária (PCO) – 45s.

By means of the Elections Act (Act no. 9,504/1997), the political advertising of candidates running for president at the free air time must take place on Tuesdays and Wednesdays and on Saturdays from 7:00 a.m. to 7:25 a.m. and from 12:00 p.m. to 12:25 p.m. on radio; and from 1:00 p.m. to 1:25 p.m. and from 8:30 p.m. to 8:55 p.m. on TV.

In a drawing held in the Court, the order for broadcasting the political advertising in the free air time on radio and TV will be as follows: Coligação Unidos pelo Brasil, PCB, PSTU, Coligação Muda Brasil, Coligação Com a Força do Povo, PRTB, PSDC, PCO, PSC, PV and PSol.  Such will be the order of the free air time of August 19.

In the following programs, there will be alternate day system, without prejudice to the established order, and the political party or coalition whose program was presented last must be presented first and so on.

The periods indicated were obtained by using the criteria of article 36 of TSE Resolution no. 23,404/2014, considering the number of political parties or coalitions to have requested the registration of their candidate for president of Brazil and respective representation in the Chamber of Deputies.

Second round

In the event of elections second round, the limit date for beginning the new free air time is October 11, 15 days before the dispute. Such time ends on October 24, two days before the second round.

If there is second round, the 20-minute blocks on radio and TV will be equally distributed between the parties or coalitions of the competing candidates, beginning with the candidate with higher number of votes and alternating such order at each program.
